This Privacy Policy describes the way in which we collect, use, process and communicate data concerning you, including personal data, in relation to the products / services offered by PENGO S.p.a. listed here below:

- Marketing and distribution of household products for the kitchen, furniture, gift, catering, childcare and leisure. 


DATA PROCESSING HOLDERS 

The "Data Holder" is the company PENGO S.p.A. with headquarters in Via A. Pigafetta n. 3, 36061 Bassano del Grappa (VI), as responsible for the provision of the aforementioned products / services.

1. TYPES OF DATA WE COLLECT

PENGO S.p.A. collects two general categories of data:

1.1. Information directly provided by you

When you use the site to request information for the above products, you will need to provide some data including the name of your company, your name and surname, telephone and fax, city, province, state and VAT number.

This information is necessary for the proper execution of the request forwarded to us and allows us to act in compliance with legal obligations. Without this data, we may not be able to provide you with all the information requested.

1.2 Information we collect automatically from the use of the website

We collect information regarding your interactions with the site, including, for example, pages or other content you view, your researches, etc.

When you visit or otherwise use the site or perform a research, we register your usage data. We use logins, cookies, device information and IP addresses (Internet protocol) to identify you and record the operations you perform.

We use cookies and other similar technologies, including, for example, web beacons, pixels and mobile device identifiers. We may also allow our business partners to use these tracking technologies on the site or engage third parties to monitor user behaviour on our behalf. Notwithstanding that you can disable the use of cookies through your browser settings, the site does not currently respond to a "Do Not Track" signal in the HTTP header, coming from your browser or mobile application, due to the lack of standardization of the modalities of interpretation of the signal. 2. HOW WE USE YOUR DATA

We use the data we hold regarding you to provide and customize our services (including advertisements), also with the help of automated systems (and of the conclusions we draw from them), in order to make these data more relevant and useful for you and for others.

We use your data for the activity related to our products / services as indicated above.


2.2 Provide, customize, evaluate and improve our advertising and our marketing:

- Sending promotional messages, marketing information, advertising and other information that may be of interest to you based on your preferences (including information regarding PENGO S.p.a. ,or a partner, campaigns or services).

- Customize, measure and improve our advertising.

We will process your personal data for the purposes listed in this section based on the legitimate interest in carrying out marketing activities in order to offer you services of your potential interest.

You may choose not to receive our marketing communications by following the unsubscription instructions included therein.

3.1 With your consent

With your consent, we may share your data, including personal data to make our service more effective. This happens when you authorize the use of data by external partners.


3.2 Service providers

We use third parties not only to enforce the contract / order but also to help us provide other services (e.g. maintenance, analysis, review, payments, fraud detection, marketing and development). These third parties will have access to your information to the extent reasonably necessary to perform these activities on our behalf and will be obliged not to disclose them and not to use them for other purposes.

3.4 Changes of corporate control or sale of the company

We may also share your personal data as part of a sale, merger or change of corporate control or in preparation for any such event. Any other entity that purchases our company or part of our activities will not have the right to continue using your data. In such cases, you will be informed before your personal data is transferred and become subject to a different privacy policy.

4. PARTNERS AND THIRD PARTY INTEGRATIONS

The website may contain links to websites or third-party services, such as, for example, third-party integrations, co-branded services or third-party brand services ("Third-party Partners"). PENGO S.p.a. owns or controls such third party Partners and when you interact with them you may provide your data directly to them, PENGO S.p.a. or to both. 


5. RIGHTS OF THE INTERESTED PARTY

5.1 Correction of inaccurate or incomplete information

You have the right to ask us to correct inaccurate or incomplete personal data concerning you.


5.2 Portability and access to data

In some countries, the law applicable allows you to request copies of personal information in our possession. You may also have the right to request copies of personal data that you have provided in a structured format, commonly used and readable electronically, and / or request us to transmit this information to another service provider (where technically feasible).


5.3 Storage and deleting of data

In general, PENGO S.p.a. keeps your personal data for the time necessary to execute the contract / order with you and to fulfill legal obligations. If you no longer wish PENGO S.p.A. to use your data in order to provide you with the products for which you have requested information, you can ask us to delete your personal information. We remind you that if you decide to request the elimination of your personal data:

- - We may retain some to the extent necessary to fulfil our legal obligations. For example, PENGO S.p.a. may retain some of your data for tax obligations, reports and legal investigations for a period not exceeding five years (tax obligations) and ten years (judicial obligations);

- - Because we protect our databases from accidental loss or data theft, residual copies of your personal data may not be removed from our backup systems for a limited period of time (24 months).


5.4 Withdrawal of consent and limitation of the processing of personal data.

If you have given consent to PENGO S.p.a for the processing of your personal data, you can, at any time, revoke this consent by sending us a communication specifying which consent you would like to revoke. We remind you that the withdrawal of consent does not affect the legitimacy of any treatment activity based on it before your withdrawal. Furthermore, you have the right to limit the way in which your personal data is used by PENGO Spa, when one of the following hypotheses occurs: 1) when you dispute the accuracy of your data, for the period necessary for the data holder to verify the data’ accuracy; 2) when the processing is illegal and you oppose the cancellation of your personal data; 3) when PENGO S.p.a. no longer needs it for the purposes of processing, personal data are necessary to verify, exercise or defend your right in court; 4) when you oppose treatment pursuant to Section 5.5. below, pending verification of the possible prevalence of the legitimate reasons of PENGO S.p.a on yours.

5.5 Opposition to the processing of personal data

You can ask PENGO S.p.a not to process your personal data for specific purposes (including profiling) where such processing is based on legitimate interest. If you oppose this treatment, PENGO S.p.a. will no longer process your personal information for these purposes unless you are able to demonstrate binding legitimate reasons for processing or if such processing is necessary to establish the assessment, exercise or defence of a right in court.


Where your personal data is processed for marketing purposes, you may at any time request PENGO S.p.a to cease processing such data for direct marketing purposes, by sending an e-mail to opt-out@pengospa.it .


5.6 Submission of complaints

You have the right to complain about the data processing activities carried out by PENGO S.p.a. with the authorities responsible for data protection: Guarantor for the Protection of Personal Data http://www.garanteprivacy.it. 

6. SAFETY

PENGO S.p.a constantly implements and updates security measures of an administrative, technical and organizational nature aimed at protecting your data from unauthorized access by third parties, from destruction or alteration. Some of the security measures we use to protect your information are: firewall, cryptography and access controls to information.


7. CHANGES TO THIS PRIVACY POLICY

PENGO S.p.a reserves the right to modify this Privacy Policy at any time in accordance with this section. In the event of changes to this Privacy Policy, we will post the updated version on the website and update the "Last Updated" date at the top of this document. We will also inform you of changes made by e-mail at least thirty (30) days before the date of their entry into force. If you do not agree with the Privacy Policy as amended, you may withdraw your consent to the processing of data as indicated in point 5. If you do not withdraw your consent before the date of entry into force of the updated Privacy Notice, the Data processing will be subject to the Privacy Policy as last amended.
